Terms of service

OCTY terms of service

These terms apply to consumer purchases from this website and use of its content, products and services (the "Services"). Nothing in these terms excludes or restricts your statutory consumer rights or any liability that cannot lawfully be excluded.

1. Who we are

OCTY is a trading name of SH ELEVEN LTD, registered in England and Wales, company number 14577734.

Registered office: 3rd Floor, 86-90 Paul Street, London, EC2A 4NE, United Kingdom.
Email: octy@europe.com.

The registered office is for correspondence. Please request the separate parcel return address before sending goods.

2. Placing an order

Check your selected product, colour, quantity, delivery address and total before submitting your order. You must provide accurate contact and payment details and be authorised to use your chosen payment method.

We accept your order when we send an order confirmation accepting it. Your confirmation records the products and price agreed. If we cannot accept an order, we will tell you and refund any payment taken for it.

If you notice an error in your order, contact octy@europe.com promptly. We will explain whether a correction is possible. This does not affect your right to cancel.

3. Product information

The product page describes the model, capacity, power connections and included accessories. Food shown in photographs is a serving suggestion and is not included.

Screen settings can affect how colours appear. This does not remove our obligation to supply goods that match their description. Follow the operating and care instructions supplied with the product.

4. Prices and payment

Website prices are in pounds sterling (GBP) and include VAT where applicable. Delivery throughout England, Scotland and Wales, including their islands, is free. The checkout shows the total before you commit to paying.

Changes to advertised prices apply to future orders and do not change the price of an order we have already accepted. If we discover a pricing error before accepting your order, we will contact you so you can choose whether to proceed at the corrected price or cancel for a refund.

5. Delivery

We currently offer website delivery throughout England, Scotland and Wales, including their islands. Northern Ireland, the Channel Islands, the Isle of Man and destinations outside the UK are outside this delivery offer.

OCTY dispatches website orders directly, usually within 1–2 days. Dispatch is when an order is sent, not a guaranteed arrival date. If no different delivery period has been agreed, we will deliver without undue delay and within 30 days of the contract.

When we arrange delivery, the goods remain our responsibility until you, or a person you nominate to receive them, takes physical possession. Contact us if an order is lost, damaged or delayed in transit. We will handle the issue with the carrier; your legal rights relating to late or failed delivery remain unaffected.

6. Cancellation and returns

For a change of mind, tell us within 14 days after the day you receive your goods, then return them within 14 days after telling us. Customers pay direct return postage for non-faulty change-of-mind returns. OCTY covers reasonable return postage for faulty, damaged-on-arrival, incorrect or misdescribed goods.

Our returns policy explains the full cancellation and refund process and includes an optional cancellation form:

The parcel return address is provided on request at octy@europe.com. You may notify us of cancellation immediately without waiting for a reply, an address or our approval.

7. Faulty or misdescribed goods

We are responsible for supplying goods that are of satisfactory quality, fit for their particular purpose where required by law, and as described. Contact octy@europe.com if you believe a product does not meet these standards.

Your rights to a refund, repair or replacement under consumer law are separate from change-of-mind returns and are not limited by that 14-day deadline.

8. Privacy

Our privacy policy explains how personal information is handled:

9. Relationship with Shopify

Octy is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Octy. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Octy, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Octy.

This section is subject to the protection of statutory rights and non-excludable liabilities stated at the start of these terms.

10. Using this website

Use the website lawfully. Do not submit fraudulent information, interfere with its operation, upload malicious software, infringe other people's rights or misuse account access.

The website's branding and content belong to their respective owners. You may browse and use the website to make purchases and obtain product support. Other use of protected content requires permission unless the law allows it.

We may restrict access to address misuse or security problems. This does not remove rights arising from an order already accepted.

11. Our responsibility

We are responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We do not exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, defective products where the law imposes liability, or breach of your statutory consumer rights.

12. Questions and complaints

Email octy@europe.com with your order number, if available, and an explanation of the issue. We will investigate and contact you about the proposed resolution.

You may also write to OCTY, c/o SH ELEVEN LTD, at the registered office above. Sending a complaint or cancellation notice does not require prior approval.

13. Changes and applicable law

The terms in force when we accept your order apply to that order. Later website updates do not retrospectively reduce your rights.

These terms are governed by the law of England and Wales. This does not take away mandatory consumer protections or your right to bring proceedings in the courts available to you under applicable law, including the courts where you live in the UK.

If a provision cannot lawfully be enforced, the remaining provisions continue to apply where possible. Nothing in these terms removes your right to rely on information or statements that the law makes part of your contract.

14. Agents

14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using persons device, without direct supervision.

14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.

14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.

14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans, (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer, (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.
